David W. Elrod recognized as a “Defender" by the Dallas Business Journal
David W. Elrod was selected as one of only fifteen attorneys nominated by their peers and the judiciary as the “Defenders” of Dallas companies, published by the Dallas Business Journal.
The article included an interview in which Mr. Elrod was asked about companies' vulnerability to "bet-the-company" litigation, to which he responded, "Depending on the size of the company and the nature of the litigation, a company may be very vulnerable. For smaller companies and start-ups, bet-the-company litigation can occur anytime the assets of the company are at risk and in situations that result in large, uninsured exposure for the company. There are things companies can do to make them more or less vulnerable to this type of litigation. They should meet with counsel before an issue ever arises to make sure they take the necessary actions to protect client lists, trade secrets and intellectual property in a manner that will prevail in court. Protecting a company against bet-the-company litigation must occur long before a lawsuit is on the horizon and requires a partnership with lawyers who have actually tried bet-the-company cases."
