$16.5 Million Arbitration Award Affirmed

On November 29, 2007, the Unites States District Court for the Southern District of Texas confirmed the $16.5 million award of a panel of arbitrators from the American Arbitration Association to Elrod’s client, Gas Transmission Northwest Corporation (“GTN”) in the total amount of $16,078,852.05. The award, which issued following two weeks of arbitration hearings and over a year of heated litigation, favorably resolved GTN’s breach of contract claims against a well-known supplier of energy software.

“We are very proud of the result, which was simply the product of hard work, good strategy and persistence,” said lead trial counsel David Elrod. “The case presented unique software licensing and contract interpretation issues. Ultimately, the arbitration panel agreed with our interpretation.”

The award included over $2.7 Million in attorneys’ fees and costs, and over $1.8 Million in interest.
