ELROD Recovers $400,000 for Client in Tarrant County Construction Defect Suit

In April of 2007, a large commercial building in Fort Worth was severely damaged when it was struck with high-speed winds during a storm.  Large sections of concrete walls on the building collapsed.  An investigation revealed that construction defects caused or contributed to the damage.  ELROD attorneys Leane Capps Medford and Worthy Walker brought suit on behalf of the building owner against two of the contractors involved in the original construction of the building nearly a decade before.

Although the contractors asserted the damage was simply the result of a tornado, and therefore an “Act of God,” ELROD diligently prosecuted its client’s negligence and breach of contract claims against the contractors.  The client ultimately recovered $400,000 in a settlement, an amount which surpassed the actual repair costs.
