Elrod Obtains $58 Million in Judgments for Pipeline Clients

 

Elrod recently obtained final judgments for $33.4 million and $24.6 million for its clients TransCanada Gas Services Inc. and Gas Transmission Northwest Corporation.

The claims of both TransCanada and GTN were brought in connection with the reorganization of energy giant Mirant and involved long-term contracts for natural gas pipeline capacity. In prosecuting these claims to final judgment, the Elrod team handled complex issues relating to mitigation of damages, discount rates, challenges to the debtors’ proposed plan of reorganization, and interest payable under the plan and FERC regulations.

“Both of these claims presented interesting and unique challenges,” said managing partner David W. Elrod. “For instance, the court placed the GTN claim on an ambitious schedule that required the case to be fully prepared for trial in less than two months, and the TransCanada claim involved the intersection of two ongoing bankruptcy cases in different jurisdictions.”

The Mirant bankruptcy case was one of the fifteen largest in U.S. history, according to BankruptcyData.com. Creditors such as TransCanada and GTN have received distributions of stock in the reorganized Mirant Corporation (NYSE: MIR) that the market has generally valued at or above the amount of the allowed claims.
