Elrod Client TransCanada Appointed to Creditors’ Committee in Calpine Bankruptcy Case

 

In one of the largest bankruptcy cases in U.S. history, Elrod client TransCanada PipeLines Limited has been appointed as a member of the Official Committee of Unsecured Creditors of Calpine Corporation and its affiliates.

TransCanada is a natural gas pipeline company that holds a long-term contract for pipeline capacity with a Calpine-affiliated company. The contract calls for the payment of tens of millions of dollars to TransCanada over the term of the agreement. Elrod represents TransCanada in the Calpine bankruptcy case.

The Creditors’ Committee for the Calpine case consists of seven members including TransCanada. Garry Lamb and Doug McLean act on behalf of TransCanada on the Committee, and David W. Elrod represents TransCanada in connection with its Committee activities.

“Membership on the Committee is a highly prestigious and very sought-after position, but it comes with an especially heavy responsibility in a case of this size and complexity,” explained managing partner David W. Elrod. “We were pleased that the U.S. Trustee recognized from our application and interview that pipelines should be represented on the Committee as a major constituency in the case and that TransCanada was the right company to serve in that role.”

Pending in the Southern District of New York, the Calpine bankruptcy case is one of the ten largest in U.S. history, according to BankruptcyData.com, and the largest case filed since the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 went into effect, with more than $27 billion in assets at issue.
