Elrod Resolves Pipeline Claims in Maine Case, Expected Distribution Over $20 Million

 

In the bankruptcy case of a major gas-fired electric generation facility in Maine, Elrod recently obtained a resolution of the claims of TransCanada Gas Services Inc. and Portland Natural Gas Transmission System that is expected to result in more than $20 million in recovery by the firm’s clients.

The claims of both TransCanada and PNGTS in the bankruptcy case of Androscoggin Energy, LLC, involved long-term contracts for natural gas pipeline capacity. TransCanada received a fixed distribution of $8.45 million in the case. PNGTS received an allowed claim of $49.85 million, with $2.25 million paid by secured funds and the balance expected to receive distribution of approximately 35 cents on the dollar, according to in-court statements of counsel.

Elrod handled all of the bankruptcy issues in the Androscoggin case, including issues related to plan confirmation, disclosure statement matters, and the disposition of the assets of the estate, in addition to prosecuting the claims of TransCanada and PNGTS. The case also involved issues relating to the respective jurisdictional boundaries between bankruptcy courts and the Federal Energy Regulatory Commission and even involved cross-border proceedings with Androscoggin's parallel Canadian case.
